3. Dzieci (poniżej 16 lat)

Zapam jest kierowany przede wszystkim do uczniów w wieku 9–15 lat. Dla użytkowników poniżej 16 roku życia:

  • Dla przetwarzania opartego na zgodzie wymagamy zgody rodzica lub opiekuna zgodnie z Art. 8 RODO
  • Podejmujemy rozsądne starania weryfikacyjne: jednorazowy sekret trafia wyłącznie do skrzynki e-mail rodzica albo SMS-em na jego telefon, a rodzic składa wyraźne oświadczenie i akceptuje konkretne zakresy. SMS nie zawiera imienia dziecka ani innych danych osobowych — tylko link
  • Mobilna aplikacja rodzinna nie zawiera zewnętrznego SDK analitycznego
  • Nie zbieramy nazwiska — tylko imię
  • Nie profilujemy behawioralnie
  • Nie wyświetlamy reklam

Sesja próbna (przed zgodą rodzica)

Zanim rodzic potwierdzi zgodę, osoba poniżej 16 lat może przechodzić do trzech sesji próbnych dziennie (limit odnawia się o północy czasu polskiego), żeby zobaczyć, jak działa nauka w Zapam — na zestawie ze swojego konta albo na zestawie z katalogu Zapam, także takim, który zapisało na urządzeniu przed zgodą.

  • Odpowiedzi trafiają na nasz serwer i do dostawcy AI wyłącznie po to, żeby je ocenić i podpowiedzieć w trakcie sesji. Nie zapisujemy ich na serwerze ani na koncie i nie wysyłamy przy tym imienia. Na koncie zapisujemy tylko to, ile sesji próbnych wykorzystano danego dnia (dla każdej: zestaw, etap ścieżki, czas rozpoczęcia i liczbę ocenionych odpowiedzi) oraz które wyniki przeniesiono już na konto po zgodzie — bez treści odpowiedzi. Do czasu zgody na koncie czeka też sama ocena każdej odpowiedzi (poprawna / niepoprawna, z identyfikatorem fiszki), żeby wynik nie przepadł przy zmianie urządzenia, w trybie prywatnym przeglądarki albo po wyczyszczeniu jej danych.
  • W aplikacji na Androida (Android 12 i nowszy) można odpowiedzieć głosem. Mowę na tekst zamienia sam telefon: nagranie nie opuszcza urządzenia, nie trafia do nas ani do żadnego dostawcy rozpoznawania mowy. Do nas trafia tylko rozpoznany tekst, tak jak odpowiedź wpisana z klawiatury. Jeśli telefon nie potrafi rozpoznać mowy bez wysyłania nagrania, a także w przeglądarce i na iPhonie, w sesji próbnej odpowiada się pisemnie.
  • Wynik sesji czeka na urządzeniu i — jako same oceny odpowiedzi — na koncie, najdłużej 30 dni. Gdy rodzic potwierdzi zgodę, przenosimy go na konto i wtedy doliczamy nagrody za sesję.
  • Wynik usuwamy z urządzenia i z konta, jeśli rodzic odmówi lub wycofa zgodę albo po 30 dniach; z urządzenia także przy wylogowaniu. Po przeniesieniu wyniku na konto oceny z sesji próbnej usuwamy.
  • Kolejne sesje nauki, zapisywanie materiałów i zakupy wymagają zgody rodzica.

Tryb gościa (bez zgody rodzica)

Nieletni bez zgody rodzica mogą przeglądać publiczne treści w trybie gościa. Postęp nie tworzy profilu dziecka, a aplikacja nie wysyła trwałego identyfikatora gościa ani zdarzeń marketingowych lub analitycznych. Minimalna diagnostyka bez konta może zostać wysłana tylko wtedy, gdy jest potrzebna do wykrycia i naprawienia awarii.

4. Udostępnianie danych

Nie sprzedajemy danych osobowych. Korzystamy z:

  • Google Cloud Platform — hosting, Firestore (dane zaszyfrowane w spoczynku)
  • Firebase Cloud Messaging — powiadomienia push (opcjonalne)
  • SMSAPI (LINK Mobility Poland sp. z o.o.) — wysyłka SMS z linkiem zgody rodzica i kodami PIN, gdy wybrano kontakt przez SMS; podmiot przetwarzający w Unii Europejskiej (Polska), otrzymuje wyłącznie numer telefonu i treść SMS-a
  • Apple App Store / Google Play — płatności w aplikacji mobilnej
  • Stripe — płatności na stronie (nie przechowujemy danych kart)
  • Spotify API — personalizacja muzyki (opcjonalna, wymaga oddzielnej zgody)
  • Apple / Google / Google Cloud — rozpoznawanie mowy uruchamiane wyłącznie po użyciu funkcji odpowiedzi głosowej (w sesji próbnej nie przekazujemy nagrania — mowę rozpoznaje telefon)
  • Dostawcy generowania AI, mowy i muzyki — treść materiału niezbędna do wykonania wybranej przez użytkownika funkcji, a w sesji nauki także treść odpowiedzi, żeby ją ocenić (zależnie od funkcji m.in. Google AI, OpenAI, ElevenLabs lub dostawca generowania muzyki)

5. Prawa użytkownika (RODO)

  • Dostęp (Art. 15) — prawo do kopii swoich danych
  • Sprostowanie (Art. 16) — poprawianie danych
  • Usunięcie (Art. 17) — „prawo do bycia zapomnianym"
  • Ograniczenie (Art. 18) — ograniczenie przetwarzania
  • Przenoszenie (Art. 20) — eksport danych
  • Sprzeciw (Art. 21) — sprzeciw wobec przetwarzania
  • Skarga — prawo wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych

6. Usuwanie konta

Możesz usunąć konto w aplikacji (Profil → Usuń konto) albo na stronie usuwania konta. Dostęp i dane identyfikujące są usuwane od razu; pozostałe dane konta i treści użytkownika są trwale usuwane najpóźniej w ciągu 30 dni, z wyjątkiem danych, które musimy zachować przez okres wymagany prawem (np. dokumentacja rozliczeń).

7. Bezpieczeństwo

  • Szyfrowanie w spoczynku (Google Cloud)
  • Tokeny JWT z krótkim czasem życia
  • Jednorazowy link zgody dostarczany na adres e-mail rodzica albo SMS-em na jego numer telefonu

8. Przechowywanie danych

Dane identyfikujące są usuwane po potwierdzeniu żądania. Minimalny techniczny nagrobek konta, prywatne dane z podkolekcji i treści użytkownika są usuwane najpóźniej w ciągu 30 dni. Logi diagnostyczne: do 90 dni. Logi bezpieczeństwa i moderacji: do 2 lat po odłączeniu od profilu, jeśli ich zachowanie jest niezbędne do ochrony użytkowników lub dochodzenia roszczeń. Pseudonimizowany dowód zgody (bez jawnego adresu e-mail lub numeru telefonu rodzica i identyfikatora dziecka) przechowujemy przez okres aktywności zgody, a po jej wycofaniu tylko przez okres niezbędny do wykazania zgodności lub obrony roszczeń; po ustaniu tego celu jest usuwany. Dokumentacja rozliczeń jest zachowywana przez okres wymagany prawem. Wyniki sesji próbnych (na koncie tylko oceny odpowiedzi, bez ich treści) przechowujemy najdłużej 30 dni (patrz pkt 3).

9. Zmiany polityki

O istotnych zmianach poinformujemy powiadomieniem w aplikacji i emailem (jeśli wymagana jest ponowna zgoda).

3. Children (under 16)

Zapam is primarily designed for students aged 9–15. For users under 16 years of age:

  • For consent-based processing, we require authorisation from a parent or legal guardian under GDPR Art. 8
  • We take reasonable verification steps: the one-time secret is sent only to the parent's email inbox or by SMS to the parent's phone, and the parent makes an express guardian declaration and accepts specific scopes. The SMS contains no child's name or other personal data — only the link
  • The family mobile app contains no third-party analytics SDK
  • We do not collect surnames — only first name
  • We do not perform behavioral profiling
  • We do not display advertisements
  • Parents can withdraw consent in one action from the parent dashboard or via dominika@zapam.pl

Trial session (before parental consent)

Before a parent confirms consent, a person under 16 can take up to three trial sessions a day (the limit resets at midnight Polish time) to see how learning with Zapam works — on a set in their account or on a set from the Zapam catalog, including one saved on the device before consent.

  • Answers are sent to our server and to an AI provider only to grade them and give hints during the session. We do not store them on our servers or in the account, and we do not send the first name with them. The account only records how many trial sessions were used on a given day (for each: the set, path stage, start time and number of graded answers) and which results were already moved to the account after consent — never the answers themselves. Until consent, the account also keeps only the verdict for each answer (correct / incorrect, with the flashcard ID), so the result is not lost when the device changes, in private browsing or after the browser data is cleared.
  • In the Android app (Android 12 or later) answers can be given by voice. Speech is turned into text on the phone itself: the recording never leaves the device and is not sent to us or to any speech-recognition provider. We only receive the recognised text, just like a typed answer. If the phone cannot recognise speech without sending the recording, and in the browser and on iPhone, answers in the trial session are typed.
  • The session result waits on the device and — as verdicts only — in the account for up to 30 days. Once a parent confirms consent, we move it to the account and add the session rewards.
  • We delete the result from the device and from the account if the parent declines or withdraws consent, or after 30 days; from the device also on sign-out. Once the result is moved to the account, the trial verdicts are deleted.
  • Further study sessions, saving materials and purchases require parental consent.

Guest mode (without parental consent)

Minors without parental consent can browse public content in guest mode. Learning progress does not create a child profile and no persistent visitor identifier or marketing/analytics beacon is sent. Minimal account-free diagnostics may be sent only when needed to detect and fix a technical failure.

4. Data sharing

We do not sell personal data. We use:

  • Google Cloud Platform — hosting, Firestore (data encrypted at rest)
  • Firebase Cloud Messaging — push notifications (optional)
  • SMSAPI (LINK Mobility Poland sp. z o.o.) — sending the parental-consent link and PIN codes by SMS when contact by SMS was chosen; a processor in the European Union (Poland) that receives only the phone number and the SMS text
  • Apple App Store / Google Play — native-app payments
  • Stripe — web payments (we do not store card data)
  • Spotify API — music personalization (optional, requires separate consent)
  • Apple / Google / Google Cloud — speech recognition, activated only when the voice-answer feature is used (in the trial session no recording is shared — speech is recognised on the phone)
  • AI, speech and music generation providers — material content needed to perform the feature selected by the user, and during study sessions also the text of answers so they can be graded (depending on the feature, including Google AI, OpenAI, ElevenLabs or a music-generation provider)

5. Your rights (GDPR)

6. Account deletion

You can delete your account in the app (Profile → Delete account) or on the account deletion page. Access and identifying data are removed immediately; remaining account data and user content are permanently erased within 30 days, except records we must retain for a legally required period (for example accounting records).

7. Security

8. Data retention

Identifying data is erased after the request is confirmed. The minimal technical account tombstone, private subcollection data and user content are erased within 30 days. Diagnostic logs are retained for up to 90 days. Safety and moderation logs may be retained for up to 2 years after they are disconnected from the profile where necessary to protect users or establish legal claims. A pseudonymised consent receipt (without the parent's plain email address or phone number or the child's plain identifier) is kept while consent is active and, after withdrawal, only for as long as needed to demonstrate compliance or defend legal claims; it is erased when that purpose ends. Accounting records are retained for the period required by law. Trial-session results (in the account only the answer verdicts, never their text) are kept for up to 30 days (see section 3).
